Departi — Terms of Use

These Terms of Use (“Terms”) govern your use of Departi — the exchange-preparation platform available at departi.net, app.departi.net, and through the Departi mobile application (together, the “Service”).

The Service is operated by Departi Technologies Limited, a private company limited by shares incorporated in Ireland (company number 816617), with registered office at 21 The Wood, Oldbridge Manor, Drogheda, Co. Meath, A92 AD9R, Ireland (“Departi”, “we”, “us”).

By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What Departi is

Departi helps students prepare for a study-abroad exchange: practical English lessons organised around real situations, a placement test, AI-powered conversation simulations and feedback, a CV (résumé) builder, travel-readiness checklists, destination guides, and peer groups (“Hubs”). Departi is a preparation tool. It complements — and never replaces — the in-person course, school, agency, or any official requirement of your exchange program or visa.

Departi does not provide visa, immigration, legal, or educational-accreditation advice, and does not guarantee any visa outcome, admission, employment, or language-proficiency result. Placement results and CEFR-level estimates are indicative only and are not official certifications.

2. Eligibility and age

You must be at least 16 years old to use the Service. If you are under 18, you may only use the Service with the consent of a parent or legal guardian, who must review and accept these Terms on your behalf. For users in Brazil, this consent is required by the Brazilian General Data Protection Law (LGPD) and the Civil Code rules on capacity. We may suspend accounts where we have reason to believe these requirements are not met.

3. Your account

• Provide accurate information and keep it up to date.
• Keep your password and sign-in methods secure; you are responsible for activity on your account.
• One account per person. Accounts are personal and non-transferable.
• You can delete your account at any time in the app or web settings, or by emailing privacy@departi.net. Deletion is permanent (see the Privacy Policy for details and retention).

4. Free tier and the Ticket

Parts of the Service are free. Premium features are unlocked by the Ticket (internally “Departi Passe”), a one-time purchase that grants 12 fixed months of premium access from activation, after which premium access ends. The Ticket is not a subscription and there are no recurring charges.

• Price. The price shown at the moment of purchase applies. Prices may differ by country, platform, and promotional batch.
• Payment. The Ticket can be purchased on our website (departi.net), with payment processed by Stripe, or inside the iOS and Android apps as an in-app purchase through the Apple App Store or Google Play. For purchases made through the stores, Apple or Google processes the transaction and that store’s terms and policies apply to the payment. Premium access is tied to your Departi account and is available on every platform, wherever it was bought.
• Departure date. The departure date set in your profile may determine your eligibility for promotional pricing (for example, early-bird pricing), but it does not affect the duration of premium access, which is always 12 fixed months from activation.
• Refunds. Your statutory rights apply. If you purchased on the web, you may withdraw within 14 days of purchase (EU Consumer Rights Directive) — or 7 days for consumers in Brazil (Código de Defesa do Consumidor) — by contacting privacy@departi.net, provided you have not substantially consumed the premium features; where the law grants an unconditional right, the law prevails. If you purchased inside the app, refunds are handled by Apple or Google under that store’s policies and must be requested from them directly — we cannot refund a transaction we did not process. Your statutory rights are unaffected.

5. AI features

Parts of the Service — conversation simulations, speaking feedback, chat with Pip, CV generation and refinement, placement support — use artificial intelligence. AI output can be wrong, incomplete, or inappropriate despite our safeguards. It is provided for practice and guidance only. Do not rely on AI output as professional, legal, medical, immigration, or hiring advice. You are responsible for reviewing AI-generated content (for example, your CV) before using it.

Fair use limits apply to AI features (free and premium) to prevent abuse; current limits are shown in the product.

6. Your content

You retain ownership of content you submit — voice recordings, text answers, chat messages, CV information, and uploaded documents (“User Content”). You grant Departi a worldwide, non-exclusive licence to host, process, transmit, and display User Content solely to operate and improve the Service (for example: sending a voice recording to a speech-assessment provider to grade it, or generating your CV PDF). Details of how User Content is processed, and by which providers, are in the Privacy Policy. We do not use your User Content for advertising.

7. Acceptable use

You agree not to:

• use the Service unlawfully, or upload content that is illegal, infringing, hateful, or harmful;
• attempt to access other users’ accounts or data;
• reverse-engineer, scrape, bulk-download, or use bots/automation against the Service;
• abuse AI features (including attempts to extract prompts, generate prohibited content, or circumvent usage limits);
• misuse gamification (XP, streaks, rankings) through automation or fraud;
• resell or commercially exploit the Service without our written agreement.

We may suspend or terminate accounts that breach these Terms, with notice where practicable.

8. Intellectual property

The Service — including lessons, Experiences, simulations, audio, illustrations, the Pip mascot, software, and branding — is owned by Departi or its licensors and protected by intellectual-property laws. We grant you a personal, non-transferable, non-exclusive, revocable licence to use the Service for your own exchange preparation. No other rights are granted.

9. Availability and changes

We work to keep the Service available and improve it continuously, but we do not promise uninterrupted or error-free operation. We may add, change, or remove features, and may modify or discontinue the Service with reasonable notice. If we permanently discontinue the paid Service during your paid entitlement period, we will refund a fair pro-rated amount.

10. Liability

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law — including liability for death or personal injury caused by negligence, fraud, or your mandatory consumer rights in your country of residence.

Subject to that: the Service is provided “as is”; we are not liable for indirect or consequential losses, loss of opportunity (including visa refusals, missed flights, admission or employment outcomes), or losses caused by events outside our reasonable control; and our total liability arising from the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim (or €50 if you paid nothing).

11. Apple App Store terms

If you use the iOS app: these Terms are between you and Departi, not Apple. Apple has no obligation to provide support or handle claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

12. Governing law and disputes

These Terms are governed by the laws of Ireland. If you are a consumer, you also benefit from the mandatory consumer-protection rules of the country where you live (for example, Brazil’s Código de Defesa do Consumidor), and you may bring proceedings in your local courts. Before going to court, contact us at privacy@departi.net — we resolve most issues directly. EU users may also use the European Commission’s Online Dispute Resolution platform.

13. Changes to these Terms

We may update these Terms. For material changes we will give notice in the product or by email at least 15 days before they take effect. Continued use after the effective date constitutes acceptance; if you do not agree, stop using the Service and delete your account.

14. Language

These Terms are published in English, Portuguese, and Spanish. The translations are provided for convenience; in case of conflict, the English version prevails, except where the law of your country of residence requires otherwise for consumers.
